User Agreement for ArtOnTheGo247®

1. Introduction

Welcome to ArtOnTheGo247®, a creativity-game app designed to inspire and empower your artistic expression. By using this app, you acknowledge that you have read, understood, and agree to the terms outlined in this User Agreement. Please read it carefully.

2. User Eligibility

  • Users must be at least 13 years old to use the app.
  • If under 18, parental or guardian consent is required.
  • Users confirm that they are legally permitted to use this app under the laws of their jurisdiction.

3. Use of the App

  • Follow the gameplay rules for each game mode (Appease, Beauty and the Beast, Coffee Complement, etc.).
  • Respect all players when engaging in multiplayer modes.
  • Use app features responsibly and in compliance with copyright laws.
  • Users may download, share, and sell images they create within the app in accordance with this agreement.
  • When selling images, users must ensure that copyright protections, including watermarks, remain intact.

4. Copyright and Ownership of Artwork

  • All images created and downloaded from ArtOnTheGo247® are copyrighted by the Licensor.
  • Each image generated within the app is embedded with visible or invisible watermarking for protection.
  • Users may add their name, initials, or signature to downloaded artworks for branding, but this does not grant copyright ownership.
  • Unauthorized removal or alteration of copyright-protected elements is strictly prohibited.

5. Saving and Protecting Your Work

Before editing or manipulating your downloaded designs, save a copy of the original image with embedded metadata in a secure location (e.g., cloud storage or external hard drive).

6. Collaborative Play

  • Players in multiplayer modes can choose to work on a single shared canvas or create separate designs on multiple canvases
  • Designs created on separate canvases can be downloaded and merged using external tools like Canva for expanded creative possibilities.
  • All players must adhere to the chief player's initial variables and respect the collaborative process.
  • Players who have jointly participated in the creation of a collaborative artwork may, upon downloading the image, add their names, initials, or identifying tags to the image (e.g., for exhibition or sale), provided that this does not interfere with copyright protections or misrepresent copyright ownership, which remains with the Licensor.

6.1 Collaborative Artworks in Multiplayer Games

In multiplayer game modes, multiple players may contribute to a single shared artwork. By participating, you acknowledge that all versions of the artwork created during the session — including any images downloaded at different stages of progress — are collaborative works, and that all participating players are considered co-creators of those designs.

Any commercial use, resale, or public distribution of artworks created in multiplayer sessions should reflect this shared authorship, regardless of the stage at which the artwork was downloaded.

Please note that systems for managing collaborative artwork rights may vary depending on the version of the app you are using.

7. Selling and Monetization of Artwork

  • Users may sell images they create within the app, acknowledging that the copyright remains with the Licensor.
  • Downloaded designs must retain their visible or invisible watermark.
  • Users should retain an unaltered copy of the original design for proof of authorship in case of disputes.

8. Prohibited Activities

  • Alter, remove, or obscure embedded metadata or watermarks from downloaded images.
  • Use the app for illegal activities, including intellectual property infringement.
  • Modify, reverse-engineer, or attempt to extract the source code of ArtOnTheGo247®.

9. Privacy and Data Collection

  • ArtOnTheGo247® collects minimal data, such as gameplay analytics, to enhance user experience.
  • No personal data is sold or shared without user consent.

10. Liability and Disclaimer

ArtOnTheGo247® is provided on an "as-is" basis. The Licensor does not guarantee uninterrupted access or error-free functionality.

11. Termination

Violation of this agreement may result in termination of access to the app and potential legal action.

12. Changes to This Agreement

The Licensor reserves the right to modify or update this User Agreement at any time.

13. Governing Law

This agreement is governed by the laws of the United Kingdom.
